Welcome to Simply Birth. By accessing our website or placing an order, you agree to the following Terms & Conditions.
These terms are designed to be clear, fair, and consistent with Australian Consumer Law.

1. About Us

Simply Birth is an Australian family partnership that supplies birth-related products including inflatable birth pools and accessories.
Throughout this document, “we”, “our”, and “us” refer to Simply Birth, and “you” or “your” refers to the customer or user of our website.

2. Australian Consumer Law

Nothing in these Terms limits or excludes your rights under the Australian Consumer Law (ACL).
You are entitled to a replacement, repair, or refund for major faults or if goods do not perform as described.
These rights apply in addition to any guarantee we offer.

3. Ordering & Acceptance

• All orders placed through our website are subject to acceptance by us.

• We reserve the right to refuse or cancel an order at any time (for example, if a product is out of stock or incorrectly priced).

• If your order is cancelled after payment, we’ll refund you in full immediately.

• Once your order is confirmed, you’ll receive an email confirmation.

4. Payment

• Payment is due at the time of ordering.

• We accept credit/debit cards, PayPal, and Afterpay.

• Prices are listed in Australian dollars (AUD) and include GST unless stated otherwise.

• If a payment is reversed or fails, your order may be delayed or cancelled.

5. Shipping & Delivery

• We ship Australia-wide and internationally on request.

• Delivery times are estimates and may vary based on location and courier performance.

• Shipping costs are calculated at checkout and are non-refundable unless required by law.

• Risk for the goods passes to you once they are delivered to your nominated address or collected by you (whichever occurs first).

• Please inspect all items immediately upon arrival and notify us within 48 hours if anything appears damaged or missing.

6. Ownership of Goods

• Ownership (title) of goods passes to you once payment has been received in full.

• Until then, the goods remain the property of Simply Birth.

• We retain a right to recover goods that are unpaid for, to the extent permitted by law.

7. Returns & Refunds

Your rights under Australian Consumer Law always apply. In addition, we offer our own 7-day change-of-mind guarantee, subject to the following:

• You may return an unused item within 7 days of receiving it for a refund or exchange.

• The product must be unopened, unused, in its original packaging, and include all accessories.

• You are responsible for return postage costs.

• Refunds will only be processed after the returned item has been received and inspected.

• We reserve the right to decline a refund if the product is not returned in saleable condition.

• Shipping costs (original or return) are not refundable unless the item is faulty or we made an error.

• Certain items (e.g. consumables, used pools, or custom items) cannot be returned for change of mind.

• If a product is defective or not as described, contact us immediately so we can arrange a repair, replacement, or refund as required by law.

8. Product Information

• We make every effort to ensure product descriptions, images, and details are accurate.

• However, minor variations in colour, packaging, or specifications may occur due to manufacturing updates.

• If you’re unsure about product compatibility, contact us before purchasing.

9. Warranty

• Manufacturer warranties apply to certain products.

• We will assist you in liaising with the manufacturer if a warranty claim is required.

• Proof of purchase is required for all warranty and return requests.

10. Limitation of Liability

• To the extent permitted by law, Simply Birth’s total liability for any claim arising from your purchase is limited to the amount you paid for the product.

• We are not liable for indirect, incidental, or consequential losses such as loss of profits, data, or opportunity.

• This limitation does not apply to liability that cannot be excluded under the ACL.

11. Intellectual Property

• All content on this website, including logos, images, text, and product descriptions, is the intellectual property of Simply Birth.

• You may not reproduce, copy, or distribute any content for commercial use without our written permission.

12. Dispute Resolution

• If an issue arises, please contact us directly — we aim to resolve all matters quickly and fairly.

• These Terms are governed by the laws of Australia, and any disputes will be handled within Australian courts or tribunals.

• We may offer mediation before proceeding to formal action.

• We may update these Terms & Conditions periodically to reflect changes in our business or the law.

• The version posted on our website at the time of your purchase will apply to your order.
